Tort and Insurance
The areas of tort and insurance are closely connected and often interacting. Personal injury or property damage will, subject to the existence and clauses of a relevant insurance, be covered by such insurance, but the next step is often a claim of recourse from the insurance company against the tortfeasor, if one exists. An injured person is normally able to cumulate parts of the insurance cover with parts of the damages to be paid by the tortfeasor, and therefore normally has a claim both against his or her insurance company and the tortfeasor. Under Danish law, the existence of an insurance cover does, in some situations, exclude liability for the tortfeasor.
